California Police Now Need Warrant to Search Cell Phones

The California State Assembly last month unanimously approved a bill that would force police to get a warrant before searching cell phones. "This will not interfere with the legitimate needs of police," said Assemblyman Steve Knight. Cell phones, once passive pieces of equipment with no storage capacity, can now easily store gigabytes of sensitive personal information. (San Francisco Chronicle) (8/23)

This strikes me as largely correct, not the least because Courts can only deal with these issues as they are presented to them. It may take years for the “right” case regarding the application of the Fourth Amendment to technology like mobile phones to make it through the Court system. When it does, the courts will base their decision on the facts of the case before them, which may not precisely match the facts of every police-citizen encounter involving these devices.

Stretching should only happen to the point of slight discomfort. Going beyond that can cause possible injury. You can usually tell the difference between slight discomfort and pain resulting from injury. The body has a great communication system. Listen to it. If at any point you feel "injury pain" stop immediately.
